Demjanjuk now scheduled to be deported Wednesday

Demjanjuk was originally scheduled to be deported to Germany on Sunday. Late last week Judge Wayne Iskra issued an indefinite stay of the deportation. But his morning the judge revoked his own stay, saying that upon review the Immigation Board of Appeals had proper authority and had reviewed Demjanjuk’s appeals and denied them, thereby clearing the way for Demjanjuk to be deported to Germany, on Wednesday.
That doesn’t mean it’s going to happen. Count on his defense to try any number of other judges or even an appeal to the Supreme Court to attempt to block the deportation — but even they are successful in the short run, they are unlikely to prevail. Demjanjuk is claiming that his physical condition is such that deporting him is tantamount to torture — but deportation usually proceeds without regard to physical condition. That being said, Demjanjuk will be accompanied to Germany by US Justice department officials as well as medical personnel (in one report, it was said to be a nurse). Germany is also prepared to examine Demjanjuk upon his arrival to determine whether to hold him a prison medical facility.
